Criminal Law is a branch of law that deals with whether there are necessary conditions for criminal sanctioning of a criminal injustice or misdemeanor according to the Turkish Penal Code No. 5237.
Whether an act constitutes a crime, the legal issue of the crime, the perpetrator and the victim is evaluated and the existence of caste and negligence elements are investigated.
An assessment of the elements of the criminal act of the perpetrator, the conditions of criminal liability, the existence of reasons that reduce or abolish the punishment and the sanctions constitute the general subjects of the criminal law.
Within the scope of TCK numbered 5237, crimes are examined in four different categories: international crimes, crimes against individuals, crimes against society, crimes against the nation and the state.
Different crime types and criminal sanctions are mentioned in each crime category.
In this context, if there is a crime defined in the Turkish Penal Code or the legislation, after the investigation file to be opened by the Office of the Chief Public Prosecutor in the region where the crime occurred, the evidence subject to the crime is collected and witness statements are made.
The prosecutor then prepares an indictment regarding the crime in question and sends it to the relevant court. Depending on the nature of the crime, the Criminal Court of First Instance and the High Criminal Court are appointed as the court of duty.
During all these legal processes, Erderk Law Office provides legal services for the complainants and defendants and pursues lawsuits.
